how do you make those stacks display an overlay icon? is there anyway to do it other then just having a stack icon being the first file in the folder?

2 ways... change the creation date of the overlay and/or place spaces in the front of the name. This will make them appear in the front.

but there is no way to place the overlay in without putting the overlay icon in the actual stack folder?

Nope (or at least not that I know of anyways). When you place a folder in the dock it simply shows you the contents. I haven't dug too far into the core of the system to find out the answer to this though. It makes sense to me that there wouldn't be a way to place an overlay on top of the other contents of a folder in the dock and still be able to see those contents without it being in the folder itself.
